Content Removal and Complaints Policy

FLIRTcam.AI (the "Service"), operated by DevPro s.r.o., Frana Mojtu 18, Nitra, 949 01, Slovakia, European Union, is committed to maintaining a safe and lawful platform. This policy outlines how to report illegal or harmful content, how we handle such reports, and how to appeal our content moderation decisions, in compliance with the Digital Services Act (Regulation (EU) 2022/2065).

1. Reporting Illegal or Harmful Content

If you encounter content on the Service that you believe is illegal under EU or national law, or that violates our Terms of Service or Blocked Content Policy, you may report it by:

a) Using the in-app reporting feature (where available); b) Sending an email to info@flirtcam.ai.

1.1 What to include in your report

To help us process your report efficiently, please include:

a) A description of the content you believe is illegal or harmful; b) The reason why you consider the content to be illegal or in violation of our policies; c) The location of the content (e.g., username, conversation context, or any identifying information); d) Your contact information (name and email address); e) A statement that you believe in good faith that the content is illegal or violates our policies.

1.2 Reports regarding copyright infringement

For reports of copyright infringement, please follow the procedure outlined in our Copyright and Intellectual Property Policy (DMCA).

2. How We Handle Reports

Upon receiving a report, we will:

a) Send you an acknowledgment of receipt without undue delay; b) Review the reported content promptly, taking into account the severity and nature of the alleged illegality; c) Make a decision based on our Terms of Service, applicable EU and national laws, and fundamental rights (including freedom of expression); d) Notify you of our decision and the reasons for it.

2.1 Possible actions

Depending on the outcome of our review, we may:

a) Remove or disable access to the content; b) Restrict the visibility of the content; c) Suspend or terminate the account responsible for the content; d) Take no action (if the content does not violate our policies or applicable law); e) Report the content to relevant law enforcement authorities (in cases of serious illegal content, including CSAM).

2.2 Timeframes

We aim to process reports within the following timeframes:

  • CSAM and imminent threats: Immediately, with reporting to authorities
  • Other illegal content: Within 7 business days
  • Policy violations: Within 14 business days

Complex cases may require additional time. We will keep you informed of any delays.

3. Complaints and Appeals

3.1 Right to appeal

If your content was removed, your account was restricted, or your report was dismissed, you have the right to appeal our decision. You may submit an appeal within 30 days of being notified of the decision.

3.2 How to appeal

Submit your appeal by email to info@flirtcam.ai with the subject line "Appeal" and include:

a) Your name and account identifier; b) A description of the decision you are appealing; c) The reasons why you believe the decision was incorrect; d) Any supporting evidence or information.

3.3 Appeal process

Appeals are reviewed by a member of our team who was not involved in the original decision. We will:

a) Acknowledge receipt of your appeal without undue delay; b) Review your appeal thoroughly and impartially; c) Provide you with a reasoned decision in a timely manner (typically within 14 business days); d) Reverse the original decision if the appeal is upheld.

3.4 Out-of-court dispute resolution

If you are not satisfied with the outcome of your appeal, you may refer the matter to a certified out-of-court dispute settlement body in accordance with Article 21 of the Digital Services Act. You also retain the right to seek judicial remedies.

4. Content Moderation Practices

4.1 Automated moderation

We use automated content moderation tools based on proprietary LLM technology to detect content that may violate our policies or applicable law. Automated tools may:

a) Flag content for human review; b) Automatically restrict content that is clearly illegal (e.g., CSAM).

4.2 Human review

Flagged content is reviewed by trained human moderators who assess the content in context and make a final determination. Purely automated decisions that significantly affect users are always subject to human review upon request.

4.3 Transparency

In accordance with the Digital Services Act, we will publish annual transparency reports detailing:

a) The number of reports received and actions taken; b) The use of automated content moderation tools; c) The number of appeals received and their outcomes; d) The median processing time for reports and appeals.
