Digital Services Act (DSA) Compliance

As an EU-based platform, FLIRTcam.AI, operated by DevPro s.r.o., complies with the Digital Services Act (Regulation (EU) 2022/2065). This page outlines our obligations, your rights, and our content moderation practices under the DSA.

3. Legal Representative

As our company is established in the EU (Slovakia), no separate legal representative is required under DSA Art. 13.

4. Nature of the Service

FLIRTcam.AI is an AI character chat platform where users interact with artificial intelligence-generated characters. The platform generates text, images, videos, and voice content through AI algorithms. Users do not upload or share content publicly with other users β€” all interactions are between individual users and AI Companions.

5. Content Moderation

5.1 Automated moderation

We employ automated content moderation tools based on proprietary LLM technology to detect content that may violate our Terms of Service or applicable law. Automated tools are used to:

a) Detect and prevent the generation of content depicting or resembling minors; b) Detect hate speech, incitement to violence, and other prohibited content; c) Flag content for human review where automated systems identify potential violations.

5.2 Human moderation

Content flagged by automated systems is reviewed by trained human moderators. Decisions that significantly affect users (such as account termination) are always reviewed by a human.

5.3 Grounds for content moderation decisions

Content moderation decisions are based on: a) Applicable EU and national laws; b) Our Terms of Service; c) Our Blocked Content Policy; d) Our Community Guidelines; e) Fundamental rights considerations, including freedom of expression.

6. Reporting Illegal Content

If you encounter content you believe to be illegal under EU or national law, you may report it by contacting us at info@flirtcam.ai. For the full reporting procedure, including what to include in your report and how we process it, see our Content Removal and Complaints Policy.

7. Statement of Reasons

When we restrict content or a user's account, we provide a clear and specific statement of reasons, including:

a) The facts and circumstances relied upon; b) The legal or contractual ground for the decision; c) Where applicable, a reference to the automated detection method used; d) Information about the possibility to appeal the decision.

8. Complaints and Appeals

Users have the right to appeal any content moderation decision. Appeals are reviewed by a person who was not involved in the original decision. For the full complaints and appeals procedure, see our Content Removal and Complaints Policy.

If you are not satisfied with the outcome of your appeal, you may refer the matter to a certified out-of-court dispute settlement body in accordance with DSA Art. 21.

9. Transparency

In accordance with DSA Art. 15, we publish annual transparency reports covering:

a) The number of orders received from EU Member State authorities and actions taken; b) The number of reports received through our reporting mechanisms and actions taken; c) Content moderation activities, including the use of automated tools; d) The number of complaints received through our internal complaint-handling system and their outcomes; e) The median time to process reports and complaints.

10. Illegal Content Reporting to Authorities

In accordance with DSA Art. 18, where we become aware of information giving rise to a suspicion that a criminal offence involving a threat to the life or safety of a person has occurred, is occurring, or is likely to occur, we promptly inform the law enforcement or judicial authorities of the Member State(s) concerned.

This includes but is not limited to: Child Sexual Abuse Material (CSAM), threats of terrorism, and imminent threats to personal safety.

11. Content Presentation and Sorting

FLIRTcam.AI does not use algorithmic recommendation systems. Characters are presented to users as follows:

a) Manual ordering: Characters are sorted by a display order set by our editorial team, with secondary sorting by creation date. There is no algorithmic ranking based on popularity, engagement metrics, or user behavior.

b) User-controlled filtering: Users may optionally filter characters by categories such as gender, appearance traits, and age range. These filters are explicitly shown in the interface and are entirely user-initiated.

c) Optional preference pre-filter: Users may voluntarily set preferences (e.g., preferred gender, avatar style) which pre-filter the character list on subsequent visits. This is opt-in and user-controlled, not an automated profiling or recommendation system.

No behavioral tracking, engagement analysis, or collaborative filtering is used to determine which characters are shown to individual users.
